Copyright Policy & DMCA Notice

All content generated through DreamVid (the "Platform"), including but not limited to videos, images, models, data, algorithms, and derivative works (collectively, "Platform-Generated Content"), is created based on user inputs, interactions, and the Platform’s technical tools. DreamVid does not claim any ownership rights over content uploaded, submitted, or posted by users ("User-Uploaded Content") and shall not be liable for the authenticity, legality, or completeness of any User-Uploaded Content, except as explicitly required by applicable laws and regulations.

Users are solely and fully responsible for ensuring that all User-Uploaded Content, as well as any content generated through their use of the Platform, complies with all applicable overseas copyright laws, intellectual property laws, and other relevant regulations (including but not limited to the U.S. Digital Millennium Copyright Act (DMCA), the European Union’s Copyright Directive 2019/790 (CDSM Directive), and national copyright laws of countries/regions where the Platform is accessible). Users must not upload, generate, or distribute content that infringes upon the copyright, trademark, patent, trade secret, or any other intellectual property rights of any third party.

Use of the DreamVid Platform is subject to our Terms of Service, and any violation of this Copyright Policy may result in suspension or termination of user access, in addition to other legal remedies.

DMCA Compliance Statement

DreamVid complies fully with the provisions of Section 512 of Title 17 of the United States Code (17 U.S.C. § 512) of the U.S. Digital Millennium Copyright Act (DMCA) and the safe harbor provisions therein. To qualify for DMCA safe harbor protection, we have established and implemented reasonable procedures to promptly respond to valid notices of alleged copyright infringement, including removing or disabling access to allegedly infringing material upon receipt of a compliant DMCA notice.

We also reserve the right to terminate, in appropriate circumstances, the accounts of users who repeatedly infringe upon the copyrights of others, in accordance with the DMCA’s repeat infringer policy.

Submitting a DMCA Notice

If you are the owner of a copyrighted work, or a person authorized to act on behalf of the copyright owner ("Complainant"), and you believe that your copyrighted work has been used, displayed, distributed, or made available on the Platform without your prior written authorization (including unauthorized reproduction, adaptation, or distribution), you must submit a written notification (a "DMCA Notice") containing all the information required by 17 U.S.C. § 512(c)(3) and outlined below. Incomplete or non-compliant notices may delay our response or be rejected outright.

IMPORTANT NOTICE: Submitting a false, misleading, or bad-faith DMCA notice may expose you to legal liability under the DMCA (17 U.S.C. § 512(f)) and other applicable laws, including liability for damages, costs, attorneys’ fees, and injunctive relief incurred by DreamVid, the alleged infringer, or any other affected party. You are advised to consult with legal counsel before submitting a DMCA Notice if you are unsure of your rights or the validity of your claim.

Required Information for a DMCA Notice

Your DMCA Notice must include the following information (all information must be accurate and complete):

  • · A physical or electronic signature of the Complainant (or a person authorized to sign on behalf of the Complainant). For electronic signatures, a scanned copy of a handwritten signature, a digital signature compliant with applicable electronic signature laws, or a clear statement indicating your authority to sign on behalf of the copyright owner (along with your full name and contact information) is acceptable.
  • · A clear, detailed description of the copyrighted work(s) you claim has been infringed. If multiple copyrighted works are allegedly infringed by a single piece of material on the Platform, you may provide a single description covering all such works, but you must clearly identify each work. For example, if the infringed work is a video, include the title, creator, publication date, and a brief summary of the content; if it is an image, include the title, photographer, creation date, and dimensions (if applicable).
  • · Sufficient information to enable DreamVid to locate the allegedly infringing material on the Platform with reasonable specificity. This includes, but is not limited to: (a) the full URL(s) of the web page(s) where the infringing material is located; (b) the unique identifier(s) of the infringing content (e.g., video ID, post ID); (c) the username of the user who uploaded the infringing material; and (d) any other details that will help us quickly identify and access the material (e.g., timestamps for video content).
  • · Your contact information, including your full legal name, physical address, telephone number, and valid email address. This information will be used to contact you if we need to verify details of your notice or provide updates on our response.
  • · A statement by you, made under penalty of perjury, that: (a) you have a good faith belief that the use of the allegedly infringing material is not authorized by the copyright owner, its agent, or the law (e.g., fair use under 17 U.S.C. § 107); and (b) all the information contained in your DMCA Notice is accurate, and you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  • Please use the provided form below to submit your information. We will respond to your request as promptly as possible.

Additional Compliance for Non-U.S. Regions

In addition to DMCA compliance for users and complainants in the United States, DreamVid adheres to relevant copyright laws in other jurisdictions where the Platform is accessible, including but not limited to:

European Union (EU) & European Economic Area (EEA): Compliance with the Copyright in the Digital Single Market Directive (2019/790/EU, "CDSM Directive"), including provisions on copyright protection for online content, notice-and-takedown procedures, and liability of online service providers. For complainants in the EU/EEA, notices of alleged copyright infringement may also be submitted in accordance with the CDSM Directive and national implementing laws of the relevant EU/EEA Member State.

Pan-European & Other Overseas Regions: Compliance with national copyright laws of countries/regions such as the United Kingdom (Copyright, Designs and Patents Act 1988), Canada (Copyright Act), Australia (Copyright Act 1968), and Japan (Copyright Act), including their respective notice-and-takedown procedures and intellectual property protection requirements.

Counter-Notification Process

If you are a user whose content has been removed or disabled access to pursuant to a DMCA Notice (the "Alleged Infringer") and you believe that the removal or disablement was a mistake (e.g., the use of the material is authorized, constitutes fair use, or the DMCA Notice was false/misleading), you may submit a counter-notification ("DMCA Counter-Notice") in accordance with 17 U.S.C. § 512(g)(3). Your DMCA Counter-Notice must include the following information:

  • · A physical or electronic signature of the Alleged Infringer.
  • · Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
  • · A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  • · Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any federal district court in which DreamVid may be found), and that you will accept service of process from the Complainant or their agent.

Upon receipt of a compliant DMCA Counter-Notice, DreamVid will promptly forward a copy to the Complainant. If the Complainant does not file a lawsuit or other legal action seeking to enjoin the use of the material within 10 to 14 business days (as required by the DMCA), we may restore the removed material or re-enable access to it, in our sole discretion.

General Provisions

DreamVid reserves the right to modify or update this Copyright Policy at any time, without prior notice. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after the posting of modified terms constitutes your acceptance of such changes.
