Welcome to DreamVid.

These Terms of Service (“Terms”) govern your access to and use of the DreamVid website, applications, and AI-powered services (collectively, the “Service”). By accessing or using DreamVid, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

DreamVid reserves the right to modify these Terms, as well as any products, prices, or services, at any time. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

Intellectual Property & Copyright

All content available on the DreamVid website and Service, including but not limited to software, algorithms, models, interfaces, designs, graphics, logos, text, videos, audio, and documentation, is owned by or licensed to DreamVid and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any part of the Service without prior written permission from DreamVid, except for the following limited uses:

• · You may store a copy of website content on your device solely for personal, non-commercial use.
• · You may share content with third parties for non-commercial purposes, provided DreamVid is clearly credited as the source.

All rights not expressly granted are reserved by DreamVid.

Service Description

DreamVid provides AI-powered creative tools, including but not limited to:

• · Text-to-video generation
• · Image-to-video generation
• · AI video remixing and recreation
• · Other AI-driven creative services

Users may submit text, images, videos, or other inputs (“User Content”) through the Service. Based on such inputs, DreamVid generates AI-created outputs (“Generated Content”). The Service may evolve over time as technology improves and features are updated.

User Obligations & Acceptable Use

You are required to use the Service lawfully and ethically, in full compliance with all applicable local, national, and international laws and regulations.

You must not create, upload, or distribute any content that:

Exploits, abuses, or endangers children.This strictly includes any content that constitutes or facilitates child sexual exploitation and abuse, such as child sexual abuse material (CSAM). This applies to all visual media, whether photographic or computer-generated, that depicts, glorifies, or promotes the sexual exploitation of minors . It is prohibited to use the Service to create, upload, or distribute any content that sexualizes minors or facilitates inappropriate interactions with them.

Depicts or promotes sexual extortion (e.g., sextortion), which includes threatening to share an individual's private intimate images or information to coerce them·Involves the non-consensual sharing of intimate images (NCII) of any person, including AI-generated or modified intimate imagery. Contains realistic violence or gore intended to shock or disgust, including severe bodily harm, dismemberment, or charred remains, except where such content has clear documentary, educational, or newsworthy value and is presented with appropriate context and warnings·Promotes, glorifies, or provides instruction for suicide and self-harm, including content that depicts or encourages suicide, self-mutilation, or eating disorders .

Constitutes hate speech that attacks, insults, or denigrates individuals or groups based on race, ethnicity, gender, gender identity, sexual orientation, religion, disability, or other protected characteristics, or that incites violence against them.

Harasses, bullies, or threatens specific individuals with severe harm, unwanted sexualization, or the sharing of their private information without consent.

Is fraudulent, misleading, or harmful to public interest and safety,such as deceptive advertising, phishing attempts, health misinformation that could cause serious harm, or manipulated media (e.g., deepfakes) intended to deceive and cause harm.

Promotes terrorism or violent extremism by glorifying terrorist acts or organizations, assisting in recruitment, or encouraging violence against groups based on ideology.

Involves the trafficking of persons by exploiting them through force, coercion, or deception for labor, sex, or other purposes.

Infringes upon the intellectual property, privacy, or other legal rights of others.

You represent and warrant that for any content you submit (User Content):

• You own or have secured all necessary rights, licenses, and consents (including required permissions for any personal data used) to such User Content.
• The User Content does not infringe any third-party rights or violate any laws.

By submitting User Content, you grant DreamVid a non-exclusive, worldwide, royalty-free license to use, process, store, and generate content solely for the purpose of providing and improving the Service.

3. Content Review and Accountability

We reserve the right, but not the obligation, to review, monitor, and remove any content that we believe, in our sole discretion, violates these Terms or applicable laws. This is done in accordance with regional regulations like the EU Digital Services Act.

We may suspend or terminate access for users who repeatedly submit non-compliant content. However, we are not liable for any failure to review or remove such content, except as mandated by law.

4. AI-Generated Content Disclosure

In compliance with evolving regulations, such as the EU AI Act, we may label content generated using our Service to indicate its AI origin. These labels promote transparency.

You must not remove or alter these labels. Doing so may result in suspension of service and could expose you to legal liability under unfair trade practices or specific AI regulations.

5. Prohibited Activities

You agree not to engage in the following activities:

• Competitive Use: Use the Service or its outputs to develop or enhance competing AI products or models.
• Data Scraping: Extract data from the Service through unauthorized automated means.
• Reverse Engineering: Attempt to access or derive the source code, algorithms, or underlying models of the Service.
• Circumventing Controls: Bypass our security measures, access controls, or geographic restrictions.
• Account Misuse: Share your account credentials or use another user's account without authorization.

Ownership of Generated Content & Commercial Use

If you upload your own images, videos, or other materials, you retain ownership of those inputs. Subject to these Terms, you own the Generated Content created from your lawful inputs and may use it commercially.

If you use images or content of other individuals, you are responsible for obtaining all required permissions and consents. Commercial use rights apply only if such authorization has been properly obtained.

Due to the nature of AI, DreamVid does not guarantee that Generated Content will be entirely unique or free from similarities to other AI-generated outputs.

Limitation of Liability

To the maximum extent permitted by law:

• · DreamVid does not guarantee that the Service will meet all user expectations or be error-free
• · Generated Content is provided for informational and creative purposes only and does not constitute legal, medical, or professional advice
• · DreamVid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service

Use of the Service is at your own risk.

Indemnification

You agree to indemnify and hold harmless DreamVid, its affiliates, officers, directors, employees, and partners from any claims, damages, losses, liabilities, and expenses arising out of:

• · Your violation of these Terms
• · Your infringement of any third-party rights

Third-Party Linksy

The Service may contain links to third-party websites or services not controlled by DreamVid. DreamVid is not responsible for the content, policies, or practices of such third parties. Your interactions with third-party services are governed solely by their own terms.

Disclaimer

DreamVid provides the Service "as is" and "as available" without warranties of any kind, whether express or implied. DreamVid does not warrant that the Service will be uninterrupted, secure, or free of harmful components.

You are solely responsible for ensuring that your use of the Service complies with applicable laws in your jurisdiction. DreamVid does not provide legal advice.

DreamVid will review valid complaints and respond within a reasonable timeframe.

Governing Law

These Terms of Service and any separate agreements whereby we provide you shall be governed by and construed in accordance with the laws of the United Kingdom, the State of Colorado of the United States of America, and the applicable local laws of the user’s jurisdiction in the Asia-Pacific region (including but not limited to Japan, South Korea); in case of any conflict or inconsistency between the foregoing laws, for users residing in or accessing the Services from Colorado, U.S., the laws of Colorado shall prevail; for users in the Asia-Pacific region, the applicable local laws of their jurisdiction shall prevail; for all other users, the laws of the United Kingdom shall prevail.
